Conférence organisée par l’Equipe Theorhis de l’UMR 7074 CTAD

L’UMR 7074, CTAD (Eq. THEORHIS) accueille Damiano Canale et Giovanni Tuzet, tous deux professeurs à l’Université Bocconi de Milan, chercheurs en théorie et philosophie du droit, spécialistes de l’analyse du raisonnement juridique et de la théorie de l’interprétation. Ils se proposent de rendre compte de l’évolution des relations entre pragmatisme et droit.

Présentation du séminaire:
Damiano Canale and Giovanni Tuzet will start by considering C.S. Peirce’s Pragmatic Maxim and the connections it had with the work of O.W. Holmes and of some Legal Realists. Then they will move to the contemporary debate and locate some pragmatist approaches to law (in particular, Coleman’s and Leiter’s) in the logical space of what we call the Pragmatist Dilemma: either giving an account of normative concepts in terms of the web of inferences they are involved in (Pragmatist Conceptualism), or giving an empirical account of the way such concepts are used (Pragmatist Naturalism). Damiano Canale and Giovanni Tuzet will finally claim that a legal pragmatist can do both things, even though a tension remains between the horns of the dilemma.

Damiano Canale et Giovanni Tuzet ont chacun publié de très nombreux articles et ouvrages et ont, ensemble, dirigé le volume The Planning Theory of Law. A Critical Reading paru chez Springer en 2013.
